Terms and Conditions

1. Service Provider

Accommodation services are provided by Pohoda Frymburk s.r.o., Company ID No.: 05555981, registered in the Commercial Register maintained by the competent court (hereinafter referred to as the “Provider”).

The accommodation facilities Rezidence Sunny Hill and Apartments Sunny Hill are operated by Šimon Račák and Helena Račáková (hereinafter referred to as the “Accommodation Provider”).

2. Formation of the Contract

The contractual relationship between the guest (hereinafter referred to as the “Guest”) and the Provider is established upon confirmation of the reservation by the Accommodation Provider or upon payment of the required deposit.

By submitting a reservation, the Guest confirms that they have read and agree to these Terms and Conditions.

3. Payment Terms

A deposit of 50% of the total price of the stay is required at the time of booking and is payable by bank transfer, unless otherwise agreed for the specific reservation.

The reservation becomes binding once the deposit has been credited to the Provider’s bank account. The remaining balance is payable no later than upon arrival, unless otherwise agreed.

4. Pricing Based on Number of Guests and Bedroom Use

The accommodation price may vary depending on the dates of the stay, number of guests, length of stay, selected accommodation type and scope of services booked.

For four-person rooms and apartments with two separate bedrooms, the following applies: when the accommodation is booked for 1–2 guests at a reduced rate reflecting lower occupancy, only one bedroom will be prepared and made available as standard, corresponding to the number of booked guests.

If 1–2 guests wish to use both bedrooms, this request must be communicated to the Accommodation Provider in advance. In such a case, the accommodation price will be adjusted to the rate applicable to full occupancy of the respective room or apartment, i.e. the rate for 4 guests.

5. Cancellation Policy

Cancellation of a reservation must be made in writing by email. Cancellation fees are calculated based on the total price of the stay:

• 30 or more days before arrival – free cancellation; any deposit already paid will be refunded.
• 29–15 days before arrival – cancellation fee of 50% of the total price of the stay.
• 14–7 days before arrival – cancellation fee of 75% of the total price of the stay.
• 6 or fewer days before arrival or in the event of a no-show – cancellation fee of 100% of the total price of the stay.

For reservations made through external booking platforms, the cancellation policy applicable to the specific reservation agreed through the respective booking platform shall apply.

Different payment and cancellation conditions may apply to group stays or individually arranged reservations.

6. Arrival and Departure

Check-in is available from 2:00 PM and check-out must be completed by 10:00 AM, unless otherwise agreed with the Accommodation Provider.

7. Rights and Obligations of the Guest

• The Guest is required to use the accommodation, its equipment and common areas properly and for their intended purpose.
• The Guest is responsible for any damage caused during the stay by the Guest or by persons for whom the Guest is responsible.
• The Guest is required to observe quiet hours from 10:00 PM to 6:00 AM.

8. No Smoking and No Pets

Pets are not permitted in the accommodation.

The entire property is strictly non-smoking.

9. Liability for Property and Damage

The Provider is liable for items brought into the accommodation by the Guest to the extent stipulated by the applicable provisions of the Czech Civil Code.

10. Complaints

Any deficiencies in the services provided must be reported to the Accommodation Provider without undue delay during the stay so that appropriate remedial action can be taken. Any subsequent complaints must be submitted in writing.

11. Personal Data Protection

Guests’ personal data is processed in accordance with applicable legislation and the General Data Protection Regulation (GDPR).

12. Final Provisions

These Terms and Conditions are valid and effective from the date of their publication on the Accommodation Provider’s website.

The legal relationship between the Provider and the Guest is governed by the laws of the Czech Republic.

If individual terms or different conditions have been agreed for a specific reservation or through a booking platform, such terms shall take precedence over the relevant provisions of these general Terms and Conditions.
